Slamming a city inspector of police for acting in a highhanded manner and continuing the probe despite a clear order of the court to depute the investigation to another officer, the Madras high court has ordered a CB-CID probe into the matter.

Chennai: Slamming a city inspector of police for acting in a high-handed manner and continuing the probe despite a clear order of the court to depute the investigation to another officer, the Madras high court has ordered a CBCID probe into the matter. Justice G Jayachandran passed the order and also restored the status of the investigation to December 20, 2018, and quashed the additional final report and charges framed against a hospital owner.

The issue pertains to a complaint filed by Dr Ramya alleging that her former employer Dr P Thomas of Chennai Fertility Centre and Research Institute tried to murder her by hiring henchmen. Thomas, however, moved the court alleging unfair probe on the part of the investigation officer and inspector of Sembiam police inspector.

Allowing his plea, the court, through an order dated December 20, 2018, directed the Puilanthope deputy commissioner of police to assign the investigation to another officer. However, taking advantage of a clerical error in the order, the Sembiam inspector continued the probe in one among the cases registered against the petitioner and filed a final report. Aggrieved, the petitioner moved the present plea. Representing the petitioner, senior advocate C Manishankar assisted by advocate Ashwinkumar, submitted that the conduct of the investigating officer who had proceeded with the investigation, and filed a final report and an additional report despite the direction by this court to transfer the investigation was non est in law. “The illegal and improper final report along with additional final report filed by the tainted IO being taken on file by the Sessions Court and has framed charges, which are also not in consonance with the facts of the case,” they added.
