In a reprieve to Anand Mahindra, chairperson of Mahindra and Mahindra, the Madras high court quashed a criminal complaint filed against him for cheating and criminal breach of trust.

CHENNAI: In a reprieve to Anand Mahindra, chairperson of Mahindra and Mahindra, the Madras high court quashed a criminal complaint filed against him for cheating and criminal breach of trust.

Justice M Nirmal Kumar passed the order on Monday while allowing a plea against the complaint. The issue pertains to a private complaint filed by V Anand before the Judicial Magistrate III, Puducherry in 2017.According to the complainant, he approached RajaRajan and Sons, an authorised dealer of Mahindra cars in Puducherry, for purchase of XUV 500 model car.

He claimed that though he had paid the entire price of the car totaling ₹14.3 lakh, the vehicle was not delivered to him as promised. Aggrieved, he filed a private complaint arraying Anand Mahindra as the first accused and the dealer as the second accused. Opposing the plea, Kalyan Jabakh, counsel for Mahindra, submitted it was a pure transaction between the complainant and the dealer, and that the petitioner (Anand Mahindra) had no role in the transaction.The complainant was represented by court appointed-counsel R Ashwin Kumar since the complainant failed to appear.

Concurring with the submissions, the judge said, “On going through the entire documents and statement, no where it is stated that the complainant had met the petitioner or written to him raising allegations against the dealer at any point of time before availing the loan or making any payment.” It has been further submitted that the dealership had been terminated for misconduct and not adhering to the dealership guidelines, the judge said.

Therefore, the petitioner had nothing to do with the dealer. There is an arbitration proceeding initiated against the dealer by the petitioner, the HC added while quashing the complaint.
